Terms of Service
1. Acceptance of Terms
By accessing or using NXTN Line services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the service. These terms apply to all users, including business tenants and their customers.
2. Description of Service
NXTN Line is a queue management platform that operates via the WhatsApp Business API. It serves businesses (tenants) who manage queues and their customers who join those queues. The platform provides queue management, real-time notifications, customer reviews, analytics, and related services.
3. Tenant Accounts
- Business registration requires accurate and complete information
- Tenants are responsible for maintaining the security of their account credentials
- Tenants must maintain compliance with WhatsApp Business Platform policies
- Tenants are responsible for managing their staff accounts and permissions
4. Customer Interaction
Customers interact with NXTN by scanning QR codes and sending messages via WhatsApp. Customer-initiated contact constitutes consent for receiving service-related messages within the WhatsApp Customer Service Window. Customers can opt out at any time by ceasing to interact with the service.
5. Acceptable Use
When using NXTN, you agree not to:
- Send spam or unsolicited promotional messages through the platform
- Misuse customer data collected through the platform
- Create fraudulent or fake queue entries
- Attempt to manipulate queue positions or system behavior
- Violate WhatsApp Business Platform policies
- Violate any applicable local laws and regulations
6. Intellectual Property
- The NXTN brand, software, and platform are proprietary to NXTN Line
- Tenant-created content such as messages, flow configurations, and queue settings belong to the tenant
- NXTN logo and branding may not be used without written permission
- QR codes generated by NXTN are licensed for the tenant's use in connection with the service
7. Service Availability
NXTN strives for high availability but does not guarantee uninterrupted service. The service depends on the WhatsApp Business Platform, which is operated by Meta. Scheduled maintenance will be performed with reasonable advance notice. NXTN is not responsible for outages or disruptions caused by the WhatsApp platform.
8. Fees and Payment
- Subscription fees are as agreed during registration and plan selection
- WhatsApp messaging costs are billed per Meta's published rates where applicable
- Payment terms are specified in the subscription agreement
- NXTN reserves the right to modify pricing with 30 days advance notice
9. Limitation of Liability
- The service is provided on an "as-is" and "as-available" basis
- NXTN is not liable for missed notifications or message delivery failures
- NXTN is not liable for WhatsApp platform changes, restrictions, or outages
- NXTN is not liable for tenant misuse of customer data
- Total liability is limited to the fees paid by the tenant in the preceding 12 months
10. Termination
- Either party may terminate the service with 30 days written notice
- NXTN may suspend or terminate accounts that violate these terms immediately
- Data export is available upon request within 30 days of termination
- After termination, tenant data will be deleted within 90 days
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Kuwait. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kuwait.
12. Modifications
NXTN may modify these Terms of Service with 30 days advance notice. Material changes will be communicated via email or platform notification. Your continued use of the service after modifications are posted constitutes acceptance of the updated terms.
